US-China AI Tensions Escalate: Sanctions and IP Theft Jeopardize Safety Dialogue

The US is contemplating sanctions on Chinese AI developers over alleged intellectual property theft and export control violations. This move risks undermining efforts to establish a bilateral dialogue on AI safety, an increasing concern.

Sanctions and AI Safety Dialogue

The United States is weighing sanctions against Chinese artificial intelligence (AI) developers, citing allegations of intellectual property theft and violations of export controls. Such actions risk derailing ongoing efforts to foster a bilateral dialogue on AI safety, which analysts contend is becoming more urgent given the increasing power of AI models and the security vulnerabilities they introduce.

On Wednesday, US officials accused Chinese AI laboratory Moonshot of employing a distillation process to create its Kimi K3 model. This process allegedly involved using outputs from Anthropic’s advanced Fable 5 model, a claim that prompted Treasury Secretary Scott Bessent to issue a warning about potential retaliatory measures.


Distillation and IP Concerns

AI distillation involves training simpler, less expensive AI models using the outputs generated by more advanced ones. The Commerce Department's Bureau of Industry and Security is investigating whether Chinese firms, including Moonshot, have unlawfully obtained and integrated advanced US chips into their models. Moonshot declined to comment on these accusations.

The burgeoning dispute highlights intensifying competition in the US-China AI race. Both nations increasingly view frontier AI as a strategic asset and a national security concern. Experts argue that cooperation on safety standards is vital, particularly as powerful AI models could be misused for cyberattacks or other malicious applications. Washington is considering restrictions on Chinese open-weight AI models, potentially escalating tit-for-tat measures and jeopardizing a planned US-China AI dialogue scheduled for September.


Export Controls and Retaliation Risk

Over several years, US export controls have sought to limit China's access to advanced chips, measures that have increasingly dominated trade discussions between the two countries. Paul Triolo, a partner at Albright Stonebridge Group, observed, "Depending on the number of Chinese companies targeted, and the nature of the punitive actions taken... the retaliation has the potential to scuttle both the AI dialogue and the September 24 meeting between Presidents Trump and Xi."

Beijing is concurrently assessing whether to restrict overseas users' access to its AI models, a retaliatory measure, according to Reuters reports. As Chinese and US frontier models continue to improve through recursive self-improvement, fostering an environment where systems can autonomously enhance their capabilities, researchers emphasize the shared incentive for both countries to cooperate on safety standards. Industry experts also point to the risks associated with open-weight models, which can be downloaded, modified, and redistributed with minimal oversight, limiting the effectiveness of software-based export controls.
